A landmark Judgement!

This refers to the recent Supreme court judgement on the allocation of 2G spectrum, cancelling all 122 telecom licences allotted on or after January 10, 2008. In the landmark piece of judgement, the SC has declared the allocation of spectrum by UPA govt as illegal and contrary to public interest.

In doing so, the SC has, in a single stroke, dashed all government efforts to vindicate their act which was a blatant example of arbitrary exercise of power.

Indeed a wonderful lesson to those who think they can pay bribes and work hand in glove with corrupt officials and politicians and get away scot free once the deal has been secured! The nation stood to be reduced to a comical farce of epic proportions. I hope all the aggrieved parties get together and demand that the bribes they paid and the favours they dished out now be returned by the corrupt!

Credit goes to SC for displaying integrity and clarity in the matter.

  1. I agree. We need to give credit to Subramanyam Swamy and Prsahant Bhushan also for using PIL in an effective manner. The worrying aspect is the retirement Justice Ghokale. Lets see how the 2G progresses after his retirement.

  2. Thanks Hariharan. The retirement of justice Ganguly is indeed a worrying factor. Its very hard to find people with his level of integrity and acumen in public life these days, and it will be difficult to fill the void. But by way of his final judgement, he has made a great contribution to our judicial system. He has set a strong precedent for our courts to follow in handling similar cases in future.

    So through this judgement Justice Ganguly has left an indelible mark in Judiciary, and will continue to be a part of it forever.

    By cancelling the licences, the SC has asserted itself powerfully for justice, transparency and ethical business practices. The decision serves as a deterrent example for those business houses who break rules and laws to maximise profits.

    There is hardly any industry in India today where unscrupulous companies have not sought to use their nexus with elected leaders and government officials to get ahead in their quest for quick and easy profits. Such behavior has been the bane of the Indian economy and reforms do not seem to have reduced their incidence.

    The lesson for corporate India from the SC's landmark judgment is that there is hardly anything to be gained — and a lot to be lost — from doing business this way.
